2. Payment Terms

  • Fixed Price Projects: Payment is typically structured as 50% upfront and 50% upon completion
  • Hourly Projects: Payment is due within 7 days of invoice receipt
  • Maintenance Contracts: Monthly or quarterly payments as agreed

2.2 Payment Methods

We accept payments via bank transfer, PayPal, and other agreed-upon methods. All prices are quoted in EUR unless otherwise specified.

2.3 Late Payments

Late payments may incur a 1.5% monthly interest charge. We reserve the right to suspend services for accounts with outstanding balances over 30 days.

3. Project Timeline and Delivery

Project timelines are estimated based on project complexity and requirements. Typical delivery times:

  • Simple websites: 2-4 weeks
  • Complex applications: 6-12 weeks
  • E-commerce sites: 4-8 weeks

3.2 Client Responsibilities

To ensure timely delivery, clients must:

  • Provide all necessary content, images, and materials within 5 business days of request
  • Respond to feedback and approval requests within 3 business days
  • Provide clear and detailed project requirements

3.3 Delays

Delays caused by client unavailability or late content delivery may extend project timelines accordingly.

4. Intellectual Property Rights

4.1 Client Ownership

Upon full payment, the client owns all custom code, designs, and content created specifically for their project.

4.2 Third-Party Components

Third-party libraries, frameworks, and components remain under their respective licenses. We ensure all third-party components are properly licensed.

4.3 Portfolio Rights

We retain the right to showcase completed projects in our portfolio and marketing materials unless otherwise agreed in writing.

4.4 Pre-existing Code

Any pre-existing code, templates, or frameworks used remain under their original licenses.

5. Warranties and Support

5.1 Warranty Period

We provide a 30-day warranty for bug fixes and technical issues related to our development work.

5.2 Support Scope

Warranty support includes:

  • Bug fixes for functionality issues
  • Browser compatibility issues
  • Performance optimization
  • Security updates for our code

5.3 Exclusions

Warranty does not cover:

  • Changes in client requirements after project completion
  • Third-party service issues
  • Content updates or modifications
  • Issues caused by client modifications

6. Limitation of Liability

Our services are provided "as is" and we make no warranties beyond those explicitly stated in these terms.

Our total liability for any claims arising from our services shall not exceed the total amount paid by the client for the specific project.

6.3 Indirect Damages

We are not liable for indirect, incidental, or consequential damages including but not limited to lost profits, business interruption, or data loss.

6.4 Third-Party Services

We are not responsible for the availability, performance, or security of third-party services, APIs, or platforms used in projects.

7. Privacy and Data Protection

7.1 Data Collection

We collect and process personal data in accordance with GDPR and our Privacy Policy.

7.2 Client Data

We maintain strict confidentiality regarding client information and project details.

7.3 Data Security

We implement appropriate security measures to protect client data and project information.

7.4 Data Retention

Project files and client data are retained for a reasonable period as required for business operations and legal compliance.

8. Termination

8.1 Termination by Client

Clients may terminate services with 7 days written notice. Payment is due for all work completed up to the termination date.

8.2 Termination by PVidev Dev

We may terminate services immediately if:

  • Client fails to make payments within 30 days of due date
  • Client requests work that violates laws or regulations
  • Client engages in abusive or unprofessional behavior

8.3 Effect of Termination

Upon termination, all outstanding invoices become immediately due, and we retain the right to suspend access to project materials until payment is received.

9. Governing Law and Disputes

9.1 Governing Law

These terms are governed by the laws of Bulgaria. Any disputes shall be resolved in the courts of Sofia, Bulgaria.

9.2 Dispute Resolution

We encourage resolving disputes through direct communication. If necessary, disputes may be resolved through mediation before legal action.

9.3 Force Majeure

We are not liable for delays or failures due to circumstances beyond our control, including natural disasters, government actions, or internet outages.

10. Modifications and Updates

10.1 Terms Updates

We reserve the right to modify these terms at any time. Updated terms will be posted on our website with the effective date.

10.2 Notification

Significant changes will be communicated to active clients via email at least 30 days before taking effect.

10.3 Acceptance

Continued use of our services after terms updates constitutes acceptance of the new terms.
